The Provisions of Food Businesses Belonging to a Category and Scale Shall have Professionals with Vocational or Technical Certification

Article 1     This Provision is prescribed in accordance with Paragraph 1 of Article 12 of the Act Governing Food Safety and Sanitation.

Article 2    Food businesses belonging to categories which shall have professionals with vocational certification are as follows:

1.        Businesses of the manufacturing, processing and preparing of meal boxes.

2.        Businesses of the manufacturing, processing and preparing of dairy products.

3.        Businesses of the manufacturing, processing and preparing of processed aquatic products.

4.        Businesses of the manufacturing, processing and preparing of processed meat products.

5.        Businesses of the manufacturing, processing and preparing of canned foods.

6.        Businesses of the manufacturing, processing and preparing of edible oils and fats.

7.        Businesses of the manufacturing, processing and preparing of egg products.

8.        Businesses of the manufacturing, processing and preparing of noodle and bean or sweet potato noodle products.

9.        Businesses of the manufacturing, processing and preparing of soy sauces.

10.    Businesses of the manufacturing, processing and preparing of edible vinegars.

11.    Businesses of the manufacturing, processing and preparing of seasoning sauces.

12.    Businesses of the manufacturing, processing and preparing of non-alcoholic beverages.

13.    Businesses of international tourist hotels with catering services.

14.    Businesses of five-star hotels with catering services.

15.    Businesses of meal boxes supplying for railway passengers.

The abovementioned food businesses belonging to categories are defined in the attached list.

Article 3    The scale and the implementation date of the abovementioned food businesses which shall have professionals with vocational certification are as follows:

1.      Businesses in Subparagraph 1 and Subparagraph 2: According to the Factory Management Act and its related regulations, businesses which are required to apply for the factory registration shall implement on the date of promulgation.

2.      Businesses in Subparagraph 3 and Subparagraph 4: According to the Factory Management Act and its related regulations, businesses in which the factory registration is required, with the amount of capital of NT $30 million or more and the food industry workers of 20 or more shall implement on the date of promulgation.

3.      Businesses in Subparagraph 5 to Subparagraph 12: According to the Factory Management Act and its related regulations, businesses in which the factory registration is required, with the amount of capital of NT $100 million or more and the food industry workers of 20 or more shall implement on August 1, 2019.

4.      Businesses in Subparagraph 5 to Subparagraph 12: According to the Factory Management Act and its related regulations, businesses in which the factory registration is required, with the amount of capital of NT $30 million or more and less than NT $100 million and the food industry workers of 20 or more shall implement on Jan 1, 2020.

5.      Businesses in Subparagraph 13: International tourist hotel businesses with business registrations or company registrations shall implement on the date of promulgation.

6.      Businesses in Subparagraph 14: Five-star hotel businesses with business registrations or company registrations shall implement on July 1, 2018.

7.      Businesses in Subparagraph 15: Businesses of meal boxes or catering services for railway passengers, with business registrations, company registrations or factory registrations, shall implement on August 1, 2019.

Article 4   Food businesses belonging to categories which shall have professionals with technical certification are as follows:

1.    Businesses of tourist hotels with catering services.

2.    Catering businesses provided group meals.

3.    Catering businesses provided school meal boxes.

4.    Catering businesses of restaurants provided banquet services.

5.    Catering Businesses.

6.    Catering Businesses of central kitchen style.

7.    Catering Businesses provided self-services.

8.    Catering businesses of general restaurants.

9.    Small-scale bakery businesses with both selling and manufacturing areas in one store.

The abovementioned catering businesses and bakery businesses belonging to categories are defined in the attached list.

Article 5  The scale and the implementation date of the abovementioned food businesses which shall have professionals with technical certification are as follows:

1.    Businesses in Subparagraph 1: Business with business registrations and company registrations shall implement on the date of promulgation.

2.    Businesses in Subparagraph 2 to Subparagraph 8: According to the Factory Management Act and its related regulations, businesses in which the factory registration is required, or with business registrations and company registrations, shall implement on the date of promulgation.

3.    Businesses in Subparagraph 9: Businesses with business registrations and company registrations shall implement on the date of promulgation.

Businesses of the manufacturing, processing and preparing of meal boxes

Referring to the manufacturing, processing and preparing of businesses in which staple foods, such as grains like rice, noodle and/or their possessed products, and raw materials, such as livestock, agricultural or aquatic products, are prepared in boxes or placed in large containers with explicit menus or product forms (including meal boxes and group meals). Such products can be provided within a short period of time to groups or individuals directly or through simple reheating (where meal boxes composed of only bakery products are not limited in this category).

Businesses of the manufacturing, processing and preparing of dairy products

Referring to plants of the manufacturing, processing and preparing of the dairy products made from raw milk or dairy products, including fresh milk, long-life milk, milk powders, flavored milk, fermented milk, condensed milk, milk fats, butter, cheese and other liquid milk products.

Businesses of the manufacturing, processing and preparing of processed aquatic products

Referring to plants of the manufacturing, processing and preparing of the food products in which aquatic animals are the main ingredients (accounting for 50% or more of the total content) and made into foods for human consumption, including dried seasoned aquatic products, salted aquatic products, dried salted aquatic products, dried vegan aquatic products and cooked dried aquatic products. However, those who are only engaged in primary processing, such as grading, sorting, cutting, storing and transporting, are not limited in this category.

Businesses of the manufacturing, processing and preparing of processed meat products

Referring to plants of the manufacturing, processing and preparing of the food products in which livestock and poultry meats or their miscellaneous parts are the main ingredients (accounting for 50% or more of the total content) and made into foods for human consumption, including pickled meat products, sausages, dried meat products and prepared meat products. However, those who are only engaged in primary processing, such as grading, sorting, cutting, storing and transporting, are not limited in this category.

Businesses of the manufacturing, processing and preparing of canned foods

Referring to plants of the manufacturing, processing and preparing of the canned foods in which the foods are packaged in close containers with commercial sterilization before or after packaging and can be stored at room temperature for a long time.

Businesses of the manufacturing, processing and preparing of edible oils and fats

Referring to plants of the manufacturing, processing and preparing of the products in which oils or fats are the main ingredients by extracting the oils or fats  from plant or animal tissues or mixing the abovementioned oils or fats.

Businesses of the manufacturing, processing and preparing of egg products

Referring to plants of the manufacturing, processing and preparing of the egg products in which eggs are the main ingredient and made into foods for human consumption, including liquid eggs, dried egg powders and pickled eggs.

Businesses of the manufacturing, processing and preparing of noodle and bean or sweet potato noodle products

Referring to plants of the manufacturing, processing and preparing of the products in which main raw materials, such as flours, rice, mung beans or other natural/modified starches are made into the shape of slender and flat through the processes of kneading with water, gelatinizing, squeezing, cooking (water boiling) or drying (hot air drying, air drying or frying).

Businesses of the manufacturing, processing and preparing of soy sauces

Referring to plants of the manufacturing, processing and preparing of the products made from plant proteins, undergoing brewing, hydrolysis, speed brewing and mixing to create seasoning liquids, and adding salts, sugars, seasonings or preservatives to make them into soy sauce products, including brewing soy sauces, instant soy sauces, hydrolyzed soy sauces, mixed soy sauces or blended soy sauces.

Businesses of the manufacturing, processing and preparing of edible vinegars

Referring to plants of the manufacturing, processing and preparing of the products made from mashes using raw materials, such as grains, fruits, alcohols, distillers grains and molasses, or adding alcohols to induce acetic acid fermentation, or flavoring with (ice) acetic acid/mixing the above two materials to create seasoning liquids with mainly the acetic acid, including brewing vinegars, blended vinegars and synthetic vinegars.

Businesses of the manufacturing, processing and preparing of seasoning sauces

Referring to plants of the manufacturing, processing and preparing of seasoning sauce products made from livestock, poultry, and agricultural and aquatic products with the addition of salts, sugars, seasonings or preservatives.

Businesses of the manufacturing, processing and preparing of non-alcoholic beverages

Referring to plants of the manufacturing, processing and preparing of the beverages in which the alcohol content is no more than 0.5 percent. However, drinking water plants are not limited in this category.

Businesses of international tourist hotels with catering services

Referring to tourist hotel enterprises with business licenses issued by the Tourist Bureau of the Ministry of Transportation and Communications and registered as international tourist hotels.

Businesses of five-star hotels with catering services

Referring to the hotels evaluated via the hotel rating system by the Tourist Bureau of the Ministry of Transportation and Communications as five-star hotels.

Businesses of meal boxes supplying for railway passengers

Referring to food businesses in which the railway transport industry has its own/attached kitchen or outsources for the manufacturing and production of the meal boxes.

Businesses of tourist hotels with catering services

Referring to tourist hotel enterprises, including international tourist hotels and general tourist hotels, with business licenses issued by the Ministry of Tourist Bureau of the Ministry of Transportation and Communications.

Catering businesses provided group meals

Referring to businesses provided catering services for schools, hospitals, plants, companies and other groups, such as staff restaurants, student restaurants and other group meals.

Catering businesses provided school meal boxes

Referring to schools entrusted catering businesses to provide meals for students (school lunch), in which the selling price of the meals are supervised or fully funded by the education authorities.

Catering businesses of restaurants provided banquet services

Referring to catering businesses with the fixed place of business (including banquets and group meals).

Catering Businesses

Referring to catering businesses without fixed place of business, in which the catering services are provided at the locations designated by the clients, such as on sport days, at conferences, weddings and other similar activities.

Catering Businesses of central kitchen style

Referring to catering businesses which can provide prepared foods of a single meal for either more than one thousand servings or two or more catering places at the same time, or pre-cooked foods with only simple heating required.

Catering Businesses provided self-services

Referring to catering businesses which provide self-services for general customers’ food selections and preferences to eat in or take away (delivery). Those who sell meal boxes and other fixed dishes are also belonged to this category.

Catering businesses of general restaurants

Including all kinds of Chinese and exotic restaurants, mainly providing foods and drinks for immediate consumption in which mostly the customers go in and order, and the staff delivers the meals to the table. All-you-can-eat restaurants which provide self-services with a variety of foods are also belonged to this category. However, fast food restaurants, self-served hot pot restaurants, self-served barbecue restaurants, breakfast shops, noodle shops and other food providing stores in which the meals can be provided only through simply reheating, preparing, and combining without professional cooking techniques are not included in this category.

Small-scale bakery businesses with both selling and manufacturing areas in one store

Referring to food manufacturing businesses (including baking, cooking, and steaming) in which in the same store, the baked goods are made at the back of the store and sold in the front of the store.
